Interesting but I think Federal pre-emption is rather clear on this point.

The problem is they could keep the plane under some other pretext so as to not conflict with Federal law. Or they could just keep the plane under their current pretext - who would be in a position to force return of the plane to its owner?

I think only the Federal government could likely effectuate this return.

So the FAA is not letting the tribe know who is supposed to have authority over airspace.

It does seem sort of crazy. I have to wonder what the politics of this are. Poor owner probably just has to buy another ship for now.
